TERMS OF USE

 

1. THESE TERMS OF USE

 

EVERY USER MUST READ AND AGREE TO THESE TERMS. BY REGISTERING ON THE SYSTEM, YOU AUTOMATICALLY AGREE TO THEM.

 

2 – OBJECT

 

This service agreement regulates the use of services provided by the 4.events tool by 4.EVENTS and establishes conditions for the service's use by the CONTRACTING PARTY.

 

3 – THE SERVICE

 

3.1. The CONTRACTING PARTY may use the services offered by the 4.EVENTS product as specified in their plan. Any services not included can be additionally acquired as needed by the CONTRACTING PARTY.

 

3.2. 4.EVENTS is not responsible for, does not indemnify, does not reimburse, and does not train users who have difficulty using the service due to a lack of technical knowledge in the field. The CONTRACTING PARTY acknowledges that they must address any technical questions about the service before contracting it. Additionally, 4.EVENTS offers communication channels for technical support without the obligation to meet response timeframes.

 

3.3. 4.EVENTS will grant a temporary license to use the system to the CONTRACTING PARTY, allowing them to use its features at their discretion while adhering to the conditions of this Agreement and 4.EVENTS' terms of use and privacy policy. The license is personal, non-exclusive, and non-transferable for system use. The CONTRACTING PARTY acknowledges and agrees that this license does not grant them any ownership or additional rights over the System, regardless of the duration of use.

 

3.4. The CONTRACTING PARTY is aware that they are solely responsible for configuring and using the system. 4.EVENTS is solely responsible for providing the system (online software) and providing support through an online chat within the system during specified service hours.

 

3.5. The CONTRACTING PARTY may not copy, modify, distribute, sell, or rent any part of the licensed System, nor may they reverse engineer or attempt to extract the source code of the System. The CONTRACTING PARTY agrees to promptly notify 4.EVENTS of any infringement or attempted infringement, damage, decompilation, or source code extraction of the System and, if possible, provide any material related to said infringement.

 

3.6. The CONTRACTING PARTY agrees to cooperate with 4.EVENTS in protecting 4.EVENTS' rights over the System. However, the CONTRACTING PARTY will not initiate any action for System violation without the prior written consent of 4.EVENTS.

 

3.7. It is agreed, hereby, that 4.EVENTS may make changes it deems necessary from one version of the System to another, including any updates, improvements, or repairs, without requiring the CONTRACTING PARTY's interference or agreement, provided that such changes do not unreasonably affect the System's proper functioning.

 

3.8. Additionally, 4.EVENTS offers communication channels for technical support, with the responsibility to provide a response within 1 business day.

 

4 – CONDITIONS OF ACCESS AND USE OF THE SERVICE

 

4.1. PLATFORM

4.EVENTS is an online platform for managing corporate events, conferences, workshops, seminars, and lectures. Other services, such as creating other websites outside the platform, are not included in the plans. Please consult technical support for information on obtaining additional computing services.

 

4.2. USAGE FEE AND PLANS

 

4.2.1 PLANS SIGNED IN 2020

There are 3 different plans available. A Free Plan with no monthly cost, with only a 9.5% fee per ticket paid through the 4.EVENTS system; an Unlimited Plan costing R$ 120.00 per month for free and paid events, plus 8% of the ticket value for paid events; a MAX Plan costing R$ 390.00 per month for paid and free events, plus 4% of the ticket value for paid events. If the CONTRACTING PARTY hosts both free and paid events, their platform will be considered paid, following the above rules for paid events. For amounts between R$ 0.01 and R$ 50.00, the fee is fixed between R$ 3.00 and R$ 5.00 per registration, depending on the fee and the plan signed. There is no charge for free categories.

 

4.2.2 PLANS SIGNED AFTER JANUARY 2021

There are 3 different plans available. A Basic Plan, free for free and paid events, plus 7.5% of the ticket value for paid events; a Starter Plan costing R$ 89.00 per month for free and paid events, plus 6.5% of the ticket value for paid events; an Up Plan costing R$ 499.00 per month for paid and free events, plus 4.5% of the ticket value for paid events; a Premium Plan, with the value negotiated case by case. If the ticket value multiplied by the administrative fee falls below R$ 3.00, the fee will be fixed at R$ 3.00. There is no charge for free categories. After the end of your plan period, you can choose to keep your data online (website, panels, etc.) for R$ 29.00 per month or request the immediate removal of all data.

 

4.3. WARRANTIES

 

4.EVENTS guarantees 95% uptime for its servers during the contracted period.

4.EVENTS guarantees daily backups of databases.

 

4.4. USE OF THE SYSTEM

 

4.EVENTS is not responsible for the misuse of the system and the content attributed to it. Therefore, the responsibility for its use, as well as all its tools and content management, lies entirely with the CONTRACTING PARTY. 4.EVENTS only provides the service and has no connection with the organization of any event.

 

4.5. MISUSE

4.EVENTS reserves the complete right to suspend the service without prior notice in the case of proven misuse of the platform, dissemination of pornographic content, promotion of drugs, sex, pedophilia, bank fraud, piracy, or any other subject that violates the current laws of Brazil. In these specific cases, there will be no refund of paid monthly fees.

 

4.6. SUSPENSION OF USE

 

4.EVENTS reserves the complete right to suspend the service without prior notice if it deems it necessary. In this case, without the CONTRACTING PARTY having any specific reason (as specified in 4.5), there will be a partial refund of the last paid monthly fee, if applicable. If it is a paid event, the balance of tickets sold can still be withdrawn.

4.7. TRAINING AND ADDITIONAL SERVICES

4.EVENTS offers its customers a comprehensive handbook with tutorials on using the system and its features. However, training through in-person or online classes is not included and must be acquired as an additional service. In addition to training, any other service not listed in the platform's features will be charged separately. These services, such as exclusive layout, creation of new modules, can be quoted and purchased directly from our customer service.

 

5. PROPERTY

 

5.1. The 4.events platform is owned by 4.EVENTS.

 

5.2. 4.EVENTS solely grants the right to use to the CONTRACTING PARTY.

 

5.3. No code will be granted to the CONTRACTING PARTY, as it is the total property of 4.EVENTS.

 

6. PAYMENT POLICY

 

6.1. The intermediation of registration fee payments is carried out by the company Iugu Serviços na Internet LTDA ME (www.iugu.com), a third-party service provider for 4.EVENTS.

 

6.2. The CONTRACTING PARTY can make a maximum of 1 withdrawal per day.

 

6.3. After the withdrawal is requested, the deposit will be made within 9 business days, and the bank statement will be made available to the CONTRACTING PARTY digitally, through the 4.EVENTS platform.

 

6.4. 4.EVENTS offers the following payment methods: bank slip, PIX, credit card with/without installment.

 

7. CHARGEBACK

 

Chargeback is the act of the bank operator (e.g., VISA/MASTERCARD) reversing a credit card payment. If this occurs, it is the complete responsibility of the CONTRACTING PARTY. They must prove the participant's presence at their event within 2 business days after the first notice, through signed receipts by the participant on the day of the event or any document proving their presence on the specified day. If it is not possible to prove, the CONTRACTING PARTY will be responsible for refunding the money to 4.EVENTS if it has already been withdrawn. This refund must occur within 5 business days after the last notice by email or phone. There will be a total of 3 attempts to contact the CONTRACTING PARTY. Failure to refund the amount will result in the addition of the CONTRACTING PARTY to the SERASA's list of negative debtors.

 

8. MAILING LIST TOOL

 

The mailing list tool involves sending automatic invitations to your contacts. As a tool for sending emails, contacts must be aware that they will be on your lists; otherwise, it will be considered spam. If the number of spam reports is high, 4.EVENTS may immediately deactivate the system without prior notice, even if the CONTRACTING PARTY has purchased add-ons to improve the tool's use. In this case, there will be no refund of paid monthly fees. If it is a paid event, the balance of tickets sold can still be withdrawn.

 

9. DURATION

 

As long as the monthly, quarterly, or annual payments are up to date, the CONTRACTING PARTY may use the platform. In the absence of payment confirmation and in the event of default, the platform will be blocked without prior notice. After 6 months of blocking or inactivity, the platform may be automatically removed.

 

10. PAYMENT POLICY

 

10.1. The intermediation of registration fee payments is carried out by the company Iugu Serviços na Internet Ltda Me (www.iugu.com), a third-party service provider for 4.EVENTS, referred to as the BANKING OPERATOR.

 

10.2. After a credit card payment is successfully approved, there is a period of 15 calendar days for the Unlimited, Max, Live, and Premium Plans, 30 calendar days for the Up Plan, and 60 calendar days for the Free and Starter Plans, for the funds to be released to the CONTRACTING PARTY. Even if the payment is installment on a credit card for 12 months, the CONTRACTING PARTY will receive the full amount, minus the administrative fee. Payments via bank slip can be withdrawn on the same day they are confirmed by the banking operator.

 

10.3. The CONTRACTING PARTY can make a maximum of 1 (one) withdrawal per day.

 

10.4. After the withdrawal is requested, the deposit is made within 9 business days, and the bank statement is made available to the CONTRACTING PARTY digitally. 4.EVENTS may request additional documents to prove event organization and/or execution if it suspects some payments are suspicious.

 

10.5. 4.EVENTS only deducts the administrative fee as an operating cost.

 

10.6. 4.EVENTS offers the following payment methods: bank slip and credit card with/without installment.

 

11. PAYMENT DISPUTE ("CHARGEBACK")

 

Clause 11. Chargeback is the act of the bank operator (e.g., VISA/MASTERCARD) reversing a credit card payment after a dispute is opened. If this occurs, it is the complete responsibility of the CONTRACTING PARTY. They must prove the participant's presence at their event within 2 business days after the first notice, through signed receipts by the participant on the day of the event or any document proving their presence on the specified day. If it is not possible to prove, the CONTRACTING PARTY will be responsible for refunding the money to 4.EVENTS if it has already been withdrawn. This refund must occur within 5 business days after the last notice by email, via bank deposit. There will be a total of 2 attempts to contact the CONTRACTING PARTY.

Paragraph 1 - With each new chargeback occurrence, 4.EVENTS may suspend any withdrawal by the CONTRACTING PARTY for a period of 15 days. If, during this period, there is a new chargeback, this period may be extended for an additional 15 days, cumulatively, without limit.

Paragraph 2 - Failure to refund the amount within 5 business days after the last notice by email will result in the addition of the CONTRACTING PARTY to the SERASA's list of negative debtors.

 

12. DELIVERY TIME

 

The agreed delivery time is defined as the time between payment confirmation by the banking operator and the actual withdrawal, which can take up to 9 business days.

 

13. DATA DELETION

 

After the end of your plan period, you can choose to keep your data online (website, panels, etc.) for R$ 29.00 per month or request the immediate removal of all data. However, please note that this clause refers to your event's data, not your personal data.

 

14. TECHNICAL SUPPORT

 

4.EVENTS offers its customers an online chat for support. This chat is operational from Monday to Friday, from 9 am to 6 pm, Brasília time. In addition to chat, we offer telephone and email support.

 

15. PRIVACY POLICY

 

4.EVENTS, through its Privacy Policy, undertakes to maintain the privacy and confidentiality of the information provided by the CONTRACTING PARTY.

 

16. INTEGRATION WITH SOCIAL NETWORKS

 

4.EVENTS allows the CONTRACTING PARTY to integrate their event with various social networks, such as Facebook, Twitter, and Google+. In doing so, the CONTRACTING PARTY assumes full responsibility for any content posted on these networks. 4.EVENTS is not responsible for the dissemination of any content, whether offensive or defamatory, posted by the CONTRACTING PARTY on these networks.

 

17. EMAIL COMMUNICATION

 

The CONTRACTING PARTY allows 4.EVENTS to communicate by email or any other means, including SMS, informing about news and promotions. To stop receiving these communications, the CONTRACTING PARTY can request their exclusion from our mailing list by clicking the link in the email.

 

18. WITHDRAWAL AND CANCELLATION

 

If the CONTRACTING PARTY wishes to withdraw from their contract, they must follow the established cancellation procedures, which are explained on the platform. The CONTRACTING PARTY is responsible for canceling their registration and for the resulting refund. If, within 6 months, the platform is reactivated, the CONTRACTING PARTY may recover their previous data by contacting the support team. Any registration recovery after 6 months will be subject to the creation of a new account. In the case of cancellation, even before the service period ends, there will be no refund of any kind. If it is a paid event, the balance of tickets sold can still be withdrawn.
